LIABILITY RELEASE, WAIVER & ASSUMPTION OF RISK AGREEMENT

1. ACKNOWLEDGMENT OF RISK
I, the undersigned Participant (and Parent/Guardian, if applicable), understand and acknowledge that participating in activities, programs, workshops, events, and services provided by Galaxy Arts Center, including but not limited to music lessons, live performances, art classes, dance, theater, summer camps, and use of facilities and equipment (collectively, the “Activities”), involves inherent risks, dangers, and hazards. These risks may include, but are not limited to:

◦ Physical injury from slips, falls, collisions, or strenuous physical activity.
◦ Injury from the use of art supplies, musical instruments, tools, or equipment.
◦ Illness, including exposure to and contraction of communicable diseases (including COVID-19).
◦ Injury or damage due to the actions or omissions of other participants, staff, or visitors.
◦ Injury during travel to, from, or between Activity locations.

I understand these risks cannot be eliminated without compromising the essential qualities of the Activities.

2. ASSUMPTION OF RISK
I VOLUNTARILY AND KNOWINGLY ASSUME ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES (as defined below) OR OTHERS, AND ASSUME FULL RESPONSIBILITY FOR MY (OR MY CHILD’S) PARTICIPATION.

3. RELEASE, WAIVER & INDEMNIFICATION
In consideration of being permitted to participate in the Activities, I, for myself, my heirs, personal representatives, assigns, and (if applicable) my child, hereby agree as follows:

a) RELEASE AND WAIVER: I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Galaxy Arts Center, its owners, directors, officers, employees, agents, volunteers, instructors, and facilities (collectively, the “Releasees”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, illness, or injury, including death, that may be sustained by me (or my child), or to any property belonging to me (or my child), WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, while participating in the Activities or on the premises.

b) INDEMNIFICATION: I further agree to INDEMNIFY AND HOLD HARMLESS the Releasees from any loss, liability, damage, or cost, including reasonable attorneys’ fees, they may incur arising out of or related to my (or my child’s) participation in the Activities or violation of any rules, whether caused by the negligence of the Releasees or otherwise.

4. HEALTH & SAFETY REPRESENTATIONS
I represent that:
◦ The Participant is in good physical and mental health and has no condition that would prevent safe participation in the Activities.
◦ I have disclosed, or will disclose in writing, any allergies, medical conditions, physical limitations, or behavioral needs that may require accommodation or special attention.
◦ In case of a medical emergency, I authorize Galaxy Arts Center staff to secure, at my (or my child’s) expense, any medical treatment or transportation deemed reasonably necessary. I accept full financial responsibility for any such costs.

5. RULES & CONDUCT
I agree to abide by all rules, instructions, and safety procedures established by Galaxy Arts Center and its staff. I understand that Galaxy Arts Center reserves the right to dismiss any participant whose behavior is deemed unsafe, disruptive, or detrimental to the program, without refund.

6. PHOTO/VIDEO RELEASE
I grant Galaxy Arts Center irrevocable permission to use photographs, audio, and video recordings of me (or my child) taken during Activities for promotional, educational, or archival purposes in any media, without compensation.

7. GOVERNING LAW & SEVERABILITY
This Agreement shall be governed by and interpreted under the laws of the State of California. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A COMPLETE RELEASE OF LIABILITY AND A BINDING CONTRACT, AND I SIGN IT OF MY OWN FREE WILL.

Cosplay Workshop Liability Release & Waiver

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, AND INDEMNITY AGREEMENT
(For Participants Under 18 Years of Age)

PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A LEGALLY BINDING DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS AND THOSE OF YOUR MINOR CHILD/WARD.

Workshop: Cosplay Workshop
Organization: Galaxy Arts Center (“GAC,” “we,” “us,” “our”)
Location: 1382 Valencia Ave Ste H Tustin CA 92780 

I. ACKNOWLEDGMENT OF RISKS
I, the undersigned Parent/Legal Guardian, on behalf of myself and the minor participant named above (“my child”), understand and acknowledge that participation in the Galaxy Arts Center Cosplay Workshop involves inherent risks, dangers, and hazards that may result in serious personal injury, illness, permanent disability, death, or property damage. These risks include, but are not limited to:

1. Use of Tools & Equipment: Cuts, burns, punctures, or other injuries from: hot glue guns, heat guns, craft knives (X-ACTO), rotary tools, scissors, sewing machines, needles, and other sharp objects.
2. Materials & Chemicals: Exposure to and potential reactions from adhesives (contact cement, super glue), solvents, sealants (Plasti Dip), paints, primers, aerosol sprays, synthetic fibers, and dust from sanding/cutting.
3. Physical Activity: Strains, sprains, or other injuries from standing, bending, lifting, or repetitive motions involved in crafting.
4. General Workshop Hazards: Slips, trips, falls, collisions with other participants or objects, and accidental entanglement.
5. Premises Risks: Defects in the facility, furniture, or equipment.

I understand that GAC will provide instruction on the safe use of tools and materials, but I acknowledge that it is impossible to eliminate all risks. My child’s participation is voluntary.

II. RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT
In consideration of GAC accepting my child’s application for participation, I hereby agree, on behalf of myself, my child, our heirs, executors, administrators, and assigns:

1. TO WAIVE ANY AND ALL CLAIMS that I or my child may have against Galaxy Arts Center, its directors, officers, employees, volunteers, agents, and independent contractors (collectively, the “Releasees”).
2. TO RELEASE THE RELEASEES FROM ANY AND ALL LIABILITY for any loss, damage, expense, injury (including death), or illness that my child may suffer, or that my next of kin may suffer, as a result of my child’s participation in the Workshop, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE on the part of the Releasees.
3. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any damage to property of, or personal injury to, any third party, resulting from my child’s participation in or conduct during the Workshop.
4. TO ASSUME ALL RISKS associated with my child’s participation in the Workshop, both known and unknown, even if arising from the negligence of the Releasees.

III. MEDICAL TREATMENT AUTHORIZATION & RESPONSIBILITY
I authorize GAC and its designated staff to obtain, or cause to be obtained, ordinary and necessary medical treatment for my child in case of injury or illness. I agree to be solely responsible for any and all costs of medical care, transportation, and treatment provided to my child that are not covered by my personal insurance. I confirm my child has adequate health insurance.

IV. RULES, CONDUCT, AND INTELLECTUAL PROPERTY
1. I agree that my child will follow all safety rules, instructions, and directions given by GAC staff at all times.
2. GAC reserves the right to dismiss my child from the Workshop, without refund, for unsafe, disruptive, or inappropriate behavior.
3. I grant GAC a non-exclusive, royalty-free license to use photographs, video, or audio recordings taken of my child during the Workshop for promotional and archival purposes.
4. I understand that workshop fees are non-refundable except at the sole discretion of GAC.

V. COVID-19 / COMMUNICABLE DISEASE ADDENDUM
I acknowledge the ongoing risk of exposure to communicable diseases, including COVID-19. I agree my child will follow all posted health and safety guidelines. I voluntarily assume all risks related to such exposure.

VI. PARENT/GUARDIAN DECLARATION
I certify that:
◦ I am the parent/legal guardian of the participating minor.
◦ I have read this agreement in its entirety and fully understand its terms.
◦ I am aware that by signing this agreement I am waiving substantial legal rights for myself and my child.
◦ My child is physically and mentally able to participate in this workshop.
◦ My child has no known allergies, health conditions, or limitations (beyond those listed below) that would affect their safe participation.

MINOR PARTICIPANT ACKNOWLEDGMENT
I have read and understand the rules and safety instructions explained to me. I agree to follow all workshop rules and instructions from the Galaxy Arts Center staff.

GALAXY ARTS CENTER COSPLAY WORKSHOP**
**STANDARD TERMS & CONDITIONS

1. Enrollment & Payment:
◦ Full payment is required to secure registration. Spaces are limited and filled on a first-come, first-served basis.
◦ All fees are non-refundable. GAC may, at its sole discretion, offer a credit for a future workshop in exceptional circumstances if notified at least 14 days prior to the start date.

2. Workshop Materials:
◦ A basic toolkit and shared consumables (glue, primer, etc.) are provided.
◦ Participants are responsible for purchasing their own primary project materials (fabric, EVA foam, etc.) as per a provided shopping list. GAC is not liable for material suitability or performance.

3. Safety & Dismissal:
◦ All participants must sign the provided Waiver and Release of Liability. Participants under 18 require a parent/guardian signature.
◦ GAC reserves the right to dismiss any participant, without refund, for behavior deemed unsafe, disrespectful, or disruptive to staff or other participants.

4. Intellectual Property & Media:
◦ Workshop curriculum and materials are the intellectual property of Galaxy Arts Center.
◦ By participating, you grant GAC permission to use photographs/videos taken during the workshop for promotional purposes in any media.

5. Limitation of Liability:
◦ To the fullest extent permitted by law, Galaxy Arts Center’s total liability for any claim arising from the Workshop shall be limited to the amount of the workshop fee paid.
◦ GAC is not responsible for lost, stolen, or damaged personal property.

6. Changes & Cancellations:
◦ GAC reserves the right to cancel or reschedule workshops due to low enrollment, instructor illness, or unforeseen circumstances. A full refund will be provided in case of cancellation by GAC.
◦ The workshop schedule and topics are subject to minor changes at the instructor’s discretion to best serve the class.

7. Governing Law:
◦ This agreement shall be governed by and construed in accordance with the laws of the State of California. Any legal action shall be brought in the courts of Orange County, California.

By registering for the Galaxy Arts Center Cosplay Workshop, the participant (and parent/guardian if a minor) acknowledges they have read, understood, and agree to be bound by these Terms and Conditions and the accompanying Waiver of Liability.
